11. Your State Privacy Rights

  1. State consumer privacy laws may provide their residents with additional rights regarding our use of their personal information.
  2. Colorado, Connecticut, Virginia, and Utah each provide their state residents with rights to:
    • Confirm whether we process their personal information.
    • Access and delete certain personal information.
    • Data portability.
    • Opt-out of personal data processing for targeted advertising and sales.
  3. Colorado, Connecticut, and Virginia also provide their state residents with rights to:
    • Correct inaccuracies in their personal information, taking into account the information’s nature processing purpose.
    • Opt-out of profiling in furtherance of decisions that produce legal or similarly significant effects.
  4. Nevada provides its residents with a limited right to opt-out of certain personal information sales. Residents who wish to exercise this sale opt-out rights may submit a request to this designated address: legal@curonix.com. However, please know we do not currently sell data triggering that statute’s opt-out requirements.
  5. If you are a resident of California, the following rights apply to you under the California Consumer Privacy Act/California Privacy Rights Act (the “CCPA”):
    • Know – the right to request that we immediately disclose the categories and specific elements of personal data collected, including the source, use and, if applicable sales to third parties, as well as the categories of third parties who received and/or purchased the same.
    • Access – the right to receive a copy of the categories and specific elements of personal data.
    • Correct/Delete – under certain circumstances, the right to request such personal data collected be deleted or corrected.
    • Opt-Out – the right to direct a business which sells personal data to third parties not to sell that consumer’s personal data.
    • Discrimination – the right to not be discriminated against by us because you have exercised any of your rights under the CCPA. This means we cannot, on the basis of the exercise of your rights thereunder, among other things, deny services to you, charge different prices or rates services, provide a different level or quality of services to you, or suggest that you will receive a different price or rate for services.
    • Preference Signals – the right to opt-out of the sale or sharing of your personal data for marketing purposes using opt-out preference signals (a) in a format commonly used and recognized by businesses and (b) is sent from a platform, technology, or mechanism that makes it clear the use of the signal is meant to have the effect of opting out of the sale and sharing of their personal data.
    • Limit the Use of Sensitive Personal Data – the right to limit the use of your sensitive personal data to only as necessary to provide you services.
    • Exercise – you may exercise the above rights no more than two (2) times during any 12-month period by completing the proper form and contacting us at legal@curonix.com. You may also submit your request through an authorized agent by providing us a form or document indicating your consent to use an unauthorized agent. In order to process your request, we may ask for additional personal data to verify your identity and/or your consent to use an authorized agent. However, please know we do not currently sell data triggering the CCPA’s opt-out requirements as it relates to the sale of personal data.
    • Under California law, California residents have the right to request in writing from businesses with whom they have an established business relationship certain information pertaining to third parties to which the business discloses personal data for marketing purposes. We do not disclose personal data to third parties for their direct marketing purposes.   6. Residents of other jurisdictions may also have certain rights regarding their personal information. To the extent applicable law provides you with the right to review, correct, update, or delete personal information that you previously have provided to us, please contact us should you wish to do so. We will respond to your request consistent with applicable law.

12. Data Security

  1. We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure.
  2. The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Website, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.
  3. Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Website.
